Regarding Assignment of Chapter 7 Cases
Effective October 12, 2026

IT IS HEREBY ORDERED, pending approval of proposed changes to Local Bankruptcy Rules 1072-1 and 1072-2, that Administrative Order No. 17-02 is vacated and the following shall apply regarding assignment of cases:

Eastern Division Cases

Chapter 7 cases from all counties in the Eastern Division must be randomly assigned among the Eastern Division judges, regardless of the county where the debtor’s residence or place of business is located.

If a debtor in a Chapter 7 case was a debtor in a previous Chapter 7 case, the new case must be assigned to the judge assigned in the previous case, unless that judge is no longer serving.

This order appoints new members to the Bankruptcy Court Rules Advisory Committee created by General Order No. 18-02. The new members, each of whom will serve a three-year term, are: Chad Husnick, Adam Silverman, Terri Long, Derek Lofland, and Professor Bruce Markell.

IT IS ORDERED that for all chapter 13 cases filed on or after June 1, 2025 the maximum Flat Fee authorized for chapter 13 debtor's counsel under Local Rule 5082-2 is $5,500, except as provided below. This amount may be requested in cases in which debtor’s counsel and the debtor enter into the Court-Approved Retention Agreement.

In cases in which debtor’s counsel and the debtor enter into the Court-Approved Retention Agreement as well as the Addendum to the Court-Approved Retention Agreement for Mortgage Modification Program, debtor’s counsel will be presumptively entitled to additional Flat Fees on the terms described in the Addendum.

Vacating General Order 22-2 regarding the adoption of Interim Bankruptcy Rule 1020 Implementing the Bankruptcy Threshold Adjustment and Technical Corrections Act
The Bankruptcy Threshold Adjustment and Technical Corrections Act expired on June 21, 2024. Official Form 101, question 13, and Official Form 201, question 8, were revised to revert the options and language in those questions to how they stood after the Small Business Reorganization Act (SBRA) was enacted effective February 2020. Updated forms, dated 06/24, are available on the court's website. Therefore, General Order 22-2 is hereby vacated.
