Your appearance on Zoom should only be your first and last name. No aliases, firm names, client names, use of other persons’ accounts will be accepted.

Upon joining the meeting, you will be placed in a waiting room.  Please wait patiently while court staff assists in moving you from the waiting room to the main room where the hearing will take place.

You may be asked to join a breakout room upon joining the main room.  The main reasons parties are asked to join a breakout room are failure to appear under your full first and last name, the need to identify a party’s role in a matter or because staff have noted you have not connected your audio correctly. 

Once admitted into the hearing, please ensure your audio is muted.  Those dialing in by phone may mute/unmute their phone by pressing *6. Your audio is to be muted until either:
- Your matter is called,
- You would like to speak up on a matter handled in chambers, or
- You are addressed directly by the court.

Your camera must be off until your matter is called.  When your matter is called, turn on your camera and leave it on until the matter is concluded.

Mute your connection again only after the case in which you are appearing is concluded in its entirety or you are given leave to by the court.

Avoid using a speakerphone or calling from a public place.  Headsets are encouraged.  Background noise is prohibited.  Parties causing unwarranted noise on the line may be muted by the court or dismissed from the hearing.

If an original motion is to be noticed for a day on which other matters in the same case are to be heard, the original motion should be noticed for the time already set – not the original motion time.

If no response has been filed, parties may withdraw a motion and not appear if they file an electronic notice of withdrawal to inform all appropriate parties that the motion is being withdrawn.

A party who objects to a motion and wants it called must file a notice of objection no later than two business days before the date of presentment.  See L.R. 9013-1(F). If no objection is timely filed, the court may grant the motion in advance.

Motions that are granted in advance will be listed as having been “Granted Without a Hearing” on the call sheet for the hearing date.  If a motion is “Granted Without a Hearing,” it will be marked as such in the Court Calendar by no later than 4:00 p.m. the day before the motion is to be presented.

If a party to a matter that has been “Granted Without a Hearing” seeks to have the matter called, the party must contact the Courtroom Deputy to request that the motion be called, and the Courtroom Deputy will call the motion.

If a motion scheduled on the call as “Granted Without a Hearing” is called, the court will either grant the motion over the objection or continue it to give the movant an opportunity to be heard.

When a motion has been heard by the court and the party seeking relief is directed to submit a draft order after the hearing, the order must be filed in fillable format on the docket via CM/ECF using the “Proposed Order” event within 14 calendar days of the hearing or as otherwise ordered.  Once the order has been filed, notice must be given to the courtroom deputy by phone or email at carlos_patterson@ilnb.uscourts.gov that the order was filed.

Motions to continue the automatic stay in effect under 11 U.S.C. § 362(c)(3) or to impose the automatic stay under § 362(c)(4) must:

1. State the case number of previous cases dismissed within one year of the filing of the present case;

2. Include copies of Schedules I and J from all previous cases dismissed within one year of the filing of the present case, and Schedules I and J from the current case;

3. State in detail the bases for continuing the stay in effect or imposing the stay; and

4. Attach a detailed affidavit containing specific facts

demonstrating all circumstances, including those relating to the

substantial change in the debtor financial or personal affairs, to rebut the presumption that the case was filed in bad faith.

Motions to modify a confirmed plan under 11 U.S.C. section 1329 must: 

1. Include amended schedules I and J if changes in income or expenses are the reason for the relief sought, and 

2. Include an affidavit signed by the debtor supporting the allegations in the motion.
