Pursuant to General Order 07-01, for all Chapter 13 cases filed on or after October 17, 2005, the debtor must file a Debtor's Declaration Regarding Domestic Support Obligations in order to receive a discharge. In joint cases, each debtor must file and complete a separate form. The form(s) must be filed at the time that the Chapter 13 trustee indicates that all plan payments have been completed. Chapter 13 trustees will now file a Notice of Completion of Plan Payments to alert the debtor that the Declaration needs to be filed. This new procedure is effective immediately.
