Model Pretrial Order for Video Trials

Thursday, May 21, 2020

In accordance with General Order No. 20-05, the court has adopted a temporary Model Pretrial Order for Video Trials. The form is a stripped-down pretrial order containing only those provisions the court has determined supply “appropriate safeguards” for video trials under Rule 43(a) of the Federal Rules of Civil Procedure, Fed. R. Civ. P. 53(a) (made applicable by Fed. R. Bankr. P. 9017). Because the form is a model and incomplete by design, individual judges will add their own provisions in each case and prepare a complete order appropriate under the circumstances.

The Model Pretrial Order is for the use of the judges rather than the bar. The form has been posted to give advance notice to the bar about the requirements for video trials in the bankruptcy court for this district.
