Several months after confirmation of the chapter 11 plan, the Creditor Trustee asked the court to interpret that plan regarding: (1) its disbursement obligations to administrative expense claimants; and (2) the funding obligations of certain parties.  Five parties in interest opposed the Creditor Trustee’s motion.  HELD: The court has jurisdiction to enforce the confirmed plan, which in effect is a contract between the parties and is interpreted accordingly.   Under the terms of the confirmed plan as well as the creditor trust agreement, the Creditor Trustee was obligated to make distributions to holders of allowed administrative expense claims.  Furthermore, the Creditor Trustee did not demonstrate by a preponderance of the evidence that one of the responding parties was obligated to fund a loan facility or that any party was required to fund an additional $500,000 payment to the Creditor Trust.
