The Debtor filed its second chapter 11 petition in two years. The prior case was dismissed for lack of authority to file. There is again a lack of authority to file in the present case, which the court dismisses under Section 1112(b) of the Code. The court found cause to dismiss as disputes at the Debtor’s Parent level are paralyzing the Debtor’s ability to move forward, and no reasonable likelihood of the proposal and confirmation of a plan exists. The court also found a lack of good faith as it appears the Debtor filed this petition to avoid appointment of a receiver in the state court.
