A chapter 13 debtor’s case was dismissed with prejudice and he was denied a discharge of his existing debts in this case and in any future bankruptcy case.
The debtor purchased a home worth $860,000. He transferred it to a trust and later to his wife for no consideration while he was facing business debts.
He and his wife sold their prior home. He stated in his Statement of Financial Affairs that he sold the prior home first and used the proceeds to purchase the $860,000 home. That was not true. He sold the prior home after purchasing the $860,000 home.
The debtor invested his portion of the proceeds from the sale of the home where they lived previously in his wife’s business; he received no ownership interest in her business.
The court found that the case was not filed in good faith, amounting to cause to dismiss the case and to deny the debtor a discharge in this case and in any future case.
