Red-lined version of amendments to local motion rules

Wednesday, April 20, 2022

By popular demand, available here is a red-lined version of the amendments to the local bankruptcy rules permitting a hybrid in-person/video motion practice once the pandemic ends.

The amendments nowhere specifically mention “video” appearances on motions.  Instead, the amendments modify or delete provisions that had required court to be held in specific physical locations and required personal appearances in court when motions were presented.  Because the amendments codify the notice-of-objection procedure used during the pandemic, former L.R. 9013-9 (motions granted without hearing) has also been deleted.  Any motion can now be granted in advance if no notice of objection is filed.
