Reaffirmation Agreements must be signed by the debtor(s).
If represented by counsel, debtor's attorney must sign certification that:
the debtor has been fully informed and that the agreement is voluntary
the agreement does not represent an undue hardship on debtor
if a presumption of undue hardship is established, that the attorney believes debtor shall be able to make the payment
If not represented by counsel or if the attorney refuses to sign the required certification:
Debtor must submit a motion for approval of the reaffirmation to the court (purpose of the hearing is to determine if there is an undue hardship on debtor).
