The notice of motion should always be filed at the time the motion is filed. If you omit it from the motion PDF file, the Notice of Motion should be filed as a separate filing.
During the filing process you will be prompted to;
Relate the notice of motion to the appropriate motion
It is not necessary to re-file the motion. Relating the Notice of Motion to the original Notice of Motion and Motion will give the judge access to the motion.
Always insert hearing date, time and location. Omitting this information will cause the motion not to appear on the Judge's call.
Note: If you already filed a Notice of Motion and are changing some information on the notice, do NOT use this event. Select the Amended Notice of Motion/Hearing event.
Step-by-Step Procedures:
Select [Bankruptcy or Adversary>Notices]
Enter case number and click Next
Select 2-Notice of Motion from event pick list and click Next
Select Party from party pick list you represent and click Next
The Attorney/Party Association screen may display. If it does, click here.
The PDF Document selection screen will display.
Click Browse button and navigate to locate the appropriate document/file
View file to verify the correct file is being selected
Click Open button and filename will appear in the browse window and click Next
reminder;Insert hearing date, time and select hearing location
Click Next
A list of entries will display.
Selection of an entry is mandatory.
If you do not relate to an existing entry, a message will display.
The Final Text screen will display.
Verify the accuracy of the docket text
Click Next to complete filing process
The Notice of Electronic Filing will display. It is the verification that the filing has been sent electronically to the court.
Copies of this notice and the document filed are emailed to all participants who receive electronic notification in the case. You have a period of 15 days for a one time free look at the document filed.
