Chapter 13 Fee Application

Effective December 13, 2004;

  1. All applications for original compensation must be notice for hearing on the date of the confirmation hearing specified in the Notice of Meeting of Creditors.

  2. All applications for compensation, whether original or supplemental, must be noticed for hearing as any original motion must be unless the following paragraph authorizes limited service of the notice.

  3. If the Notice of Meeting of Creditors discloses the amount of original compensation requested and has been served on all parties in interest, and if the hearing on compensation is notice for the original confirmation date, then the debtor's attorney need only serve the notice of the hearing on the debtor and the standing trustee, with a copy of the Notice of Meeting of Creditors attached.

  4. When an affidavit, Itemization or Model Retention Agreement are included, file as an attachment to the notice of motion and motion.

  5. Do Not include an additional motion.  The Chapter 13 Fee Application serves as the motion for both initial and post-confirmation request.

 

Step-by-Step Procedures:

  1. Select [Bankruptcy>Motions/Applications]

  2. Enter case number and click Next

  3. Select Compensation with Notice of Motion from the pick list

  1. Click Next

  2. Answer the following question; (a selection is mandatory)

Is the application for Compensation for yourself? Enter y for Yes or n for No.

Yes

No

 

The PDF Document selection screen will display.

  • Click Browse button and navigate to locate the appropriate  document/file

  • View file to verify the correct file is being selected

  • Click Open button and filename will appear in the browse window

Next, the Proposed Order must be added as an attachment to the notice of motion and motion.

NOTE: If filing Application for Compensation other than the first, enter which one is being filed (i.e. Second, Third, Fourth, etc).

  • Complete text box is applicable

  • Insert hearing date, time and select hearing location (if applicable)

  • Click Next

The Fee Processing screen will display.  

Data entered on this screen is recorded in the Professional Fees Applied For/Awarded Reports.

The Filer box will automatically be check to indicate you are the filer of the application.

  • Make a selection from Type box (Role of Professional)

  • Enter Fee Requested

  • Enter Expenses Requested

    • If no expenses are being requested enter 0.00

  • Click Next after screen is completed

 

 

The Attorney/Party association screen may appear.

  • If attorney represents the party selected, click the box to create the association

  • If attorney does not represent the party selected, do not click the box

  • Click Next

The PDF Document selection screen will display.

  • Click Browse button and navigate to locate the appropriate  document/file

  • View file to verify the correct file is being selected

  • Click Open button and filename will appear in the browse window

Next, the Proposed Order must be added as an attachment to the notice of motion and motion.

NOTE: If filing Application for Compensation other than the first, enter which one is being filed (i.e. Second, Third, Fourth, etc).

  • Complete text box is applicable

  • Insert hearing date, time and select hearing location (if applicable)

  • Click Next

The Fee Processing screen will display.  

Data entered on this screen is recorded in the Professional Fees Applied For/Awarded Reports.

The Filer box will be automatically checked for the professional who is logged on.

If a party was added to the party pick list, a Party box will appear under the type box because the party is not currently a party to the case.

If you check the Party box, the professional's name will appear in the party pick list permanently.

If the box is not checked, the professional's name will not remain in the party pick list box.

  • Make a selection from Type box (Role of Professional)

  • Enter Fee Requested for applicant

  • Enter Expenses Requested for applicant

    • If no expenses are being requested enter 0.00

  • Click Next after screen is completed

The Modify Text Editing screen will display.  Click the down arrow to select a prefix if applicable.

  1. Click Next

The Final Text screen will display.  This is your final opportunity to modify the entry before submitting the filing.

  1. Verify the accuracy of the docket text

  2. Click Next to complete filing process

The Notice of Electronic Filing will display.  It is the verification that the filing has been sent electronically to the court.

Copies of this notice and the document filed are emailed to all participants who receive electronic notification in the case.  You have a period of 15 days for a one time free look at the document filed.
