Notice of Postpetition Mortgage Fees, Expenses, and Changes (No Proof of Claim Filed) (Limited Filer)

Background: 

 

 

Rule 3002.1

 

Effective 12/1/11, E-filers who represent mortgage creditors in Chapter 13's will need to file this event when there are postpetition mortgage fees, expenses or charges and no claim has been filed.

 

   

Form B10,

Supplement #2:

There is a new official form, B10 Supplement #2 that should be used for filing this event.

  • The form should be filed within 180 days after the fees, expenses or charges are incurred.
  • The form must be served on the debtor, debtor's counsel, and the trustee.

 

Reminder

Because no Proof of Claim was filed, this event will not appear on the Claims Register. After an e-filer has filed this event, it will only appear on the Bankruptcy docket.

 

 

 

 

Step by Step Instructions: 

 

  1. Access Bankruptcy >Creditor Claimant Activity

  2. Input Case Number

  3. Click Next

  4. Select Notice of Postpetition Mortgage Fees, Expenses, and Charges (No Proof of Claim Filed)

  5. Click Next

  6. The party screen will appear. Select or add the party you represent.

  7. Click Next.
  8. The Party association screen will display if you are not already associated to your client.
  1. Click Next

  2. The following warning message will appear: 

WARNING: This event should ONLY be used if a claim has NOT been filed.

 

Click Next

  1. The following question will appear

    Has a Proof of Claim been filed?

     

    Select the No Radio Button

     

  2. Click Next
  3. The PDF Document selection screen will display.

Note: If you are attaching a Certificate Of Service , Select Attachments to Document Yes radio button

  1. Click Next

  1. Select the appropriate Radio Button (see table)

If you attached a Certificate of Service in steps 11-12, Select Yes

 

If you did not attach a Certificate Of Service in steps 11-12,

Select No

If you attached a Certificate of Service in steps 11-12, Select Yes

  • Click Next
  • Click Next
  The following warning message will display

 

 

 

  • Click Next

  1. Click Next
  1. The Final Editing Screen will display.

    Verify the final docket text

  2. Click Next to submit the transaction and complete the filing process.
